AMEWAS, INC. BACKGROUND CHECK POLICY

All offers of employment at AMEWAS, Inc. are contingent upon clear results of a thorough background check. Background checks will be conducted on all final candidates after a verbal offer is made or following state regulations regarding the timing and content of background checks.

In addition, AMEWAS, Inc. Human Resources will conduct screenings of current employees to maintain safety in the workplace and mitigate potential risks.  All employees are subject to background checks while employed with AMEWAS, Inc.  Below are a few instances that a background check is necessary:

• A report has been made to Human Resources of an arrest, court date and/or conviction that reflects on the employee’s suitability for continued employment during the course of an investigation or when an employee is transferred/hired to a new position that requires a criminal or other background check
• Reports to Human Resources that an employee is violating the AMEWAS, Inc. Conduct Standards policy
• When the safety and security of the Company premises, Company assets, and the members of the Company community have been compromised
• When it is observed and/or believed that an employee is causing harm to the business (i.e. theft or violence)
• If an employee is covered under AMEWAS, Inc. driver’s insurance, an annual Driver License Motor Vehicle Report will be reviewed

Background checks will include:

Prior Employment Verification: confirms the person’s employment with the listed companies, including dates of employment, position held and eligibility for rehire. This verification will be run on the past two employers or the previous five years, whichever comes first.

Education and Certification Verification: confirms the person’s claimed educational institution including the years attended and the degree/diploma received and/or certification credentials.

Criminal History:  confirms the person’s state and federal criminal history report.

Procedures

Candidates
• Final candidates will receive an offer of employment with a contingency of passing a background check.  At that time, the candidate will review this policy and provide consent to a background check.
• Human Resources will coordinate a background check through a third-party administrator  
• The candidate will sign disclosures and enter their personal information in the administrator’s system
• The background check will be conducted (typically, results will be presented within 36 hours)

Human Resources receives adverse information about an employee.

Results

Results of background checks are reviewed by Human Resources

• (Candidates)If the background check is faborable, Human Resources will notify the hiring manager that the candidate is approved to begin employment.
• (Candidates & employees)If the background check is unfavorable, Human Resources will review the information in consultation with legal counsel, as necessary. Other individuals that may be consulted, at the discretion of Human Resources, include the hiring manager, the operations manager, and executive leadership. A decision to hire an applicant with a job-related conviction requires the approval of executive leadership.
• If the unfavorable information is included in the report provided by the credit reporting agency, the Office of Human Resources will send the applicant/employee a pre-adverse action letter. If the decision is made not to hire/continue employment with the applicant/employee because of information included in a report, a final adverse action letter shall be sent to the applicant/employee informing the applicant of their rights under the Fair Credit Reporting Act.
• If unfavorable information is uncovered about the spouses/domestic partners of applicants/employees subject to background checks under this policy, the results of such search will be provided only to the spouse/domestic partner, and not to the applicant/employee. No pre-adverse action or adverse action letter will be sent to such individuals.
• In making the determination of job-relatedness, Human Resources will consider how recently the unfavorable incident occurred; the frequency and severity of the incident(s); the age of the individual at the time of the incident; the accuracy of information provided on the application and/or during the interview process; evidence of rehabilitation; and the safety and security of the Company premises, Company assets, and the members of the Company community, which will be the most important consideration.

Practice Notice

Offers of employment are contingent on successfully passing a background check.  If a candidate refuses a background check, AMEWAS, Inc. will not move forward with their application.

If an employee refuses a background check, AMEWAS, Inc. may follow the progressive discipline process up to and including termination.

Background check information will be maintained in a file separate from employees' personnel files for a minimum of five years.
